The form follows the nature of your income and your status as an assessee, not your profession. ITR-1 covers salaried individuals within a specified income limit; business and professional income moves you to ITR-3 or ITR-4; firms, LLPs, companies and trusts file ITR-5, ITR-6 and ITR-7 respectively. Filing on the wrong form can render the return defective, so it is worth confirming before submission.

A belated return can still be filed within the time limit the Act allows, but late filing attracts a fee under Section 234F and interest under Section 234A, and certain losses can no longer be carried forward. Filing late is materially better than not filing.

Note the section under which it was issued and the response deadline, both of which appear on the notice, then reply within that window with the documents the notice asks for. Most notices are reconciliation queries rather than allegations. Ignoring one is what turns it into an assessment made without your input.

No. TDS is tax collected in advance on your behalf by the person paying you, and it is credited against your final liability. If total TDS exceeds the tax you actually owe, the excess is refunded once your return is processed.
