Both are triggered by employee headcount, with the EPF and ESI Acts each specifying their own threshold, and ESI additionally applying only to employees within a notified wage limit. Once the threshold is crossed the obligation is continuing, and monthly contribution filings begin immediately.

Udyam registration is the recognition on which several statutory benefits depend, including protection under the delayed-payment provisions of the MSMED Act, priority sector lending eligibility and preference in certain government procurement. It is free and based on self-declaration against investment and turnover criteria.

Filing gives you an application number and the right to use the TM symbol almost immediately, but registration itself commonly takes well over a year, longer if the Registry raises an objection or a third party opposes the mark. A search before filing is what reduces the risk of both.
